General Terms & Conditions for
"New Beginnings Offer on JCB Lubricants"

The New Beginnings offer on JCB Lubricants ("Scheme") is brought to you by JCB India Limited ("JCB").

Please read these terms and conditions ("T&Cs") carefully before participating in the Scheme. You agree that, by participating in this Scheme, you are deemed to be bound by these T&Cs fully and unconditionally, and you acknowledge and agree that you satisfy all the Scheme eligibility requirements as provided herein below. For the purpose of these T&Cs, wherever the context so requires "You", "Customer" or "Your"; shall mean any natural person who is a participant in the Scheme.

1. The customer can avail a discount upto 12% on the purchase of lubricants, bases on the conditions as mentioned herein below in the table. The invoice shall contain different lubes along with minimum litres requirement as mentioned to be eligible for discount as mentioned in the below mentioned table.

2. The discount is valid only on the purchase of JCB Lubricants only. The Customer will only get the discounted invoice while purchase of JCB Lubricants under this Scheme.

3. This Scheme is valid from April 8th to 24th, 2024 (both days are inclusive). Any purchase after the business hours of April 24th,2024 shall not be considered under this Scheme

4. The scheme is not applicable on barrels and 3/5 litres lubes pack.

5. JCB and/or its dealers are not responsible for late, incomplete, incorrect, or invalid purchase of Lubricants.

6. The discount is applicable on MRP (i.e., “maximum retail price”) of the product and cannot be combined with any other offer or discount.

7. The discount will not be applicable to any taxes or duties applicable on the purchase.

8. The discount is only available for purchases made through authorized dealerships of JCB across India.

9. JCB reserves the right to modify or cancel this Scheme at any time without prior notice.

10. JCB India may amend or withdraw this Scheme if circumstances arise beyond its control.

11. This Scheme cannot be combined with any other promotions schemes.

12. All disputes to be reported to the respective authorized JCB dealership

13. In the event of any dispute, the decision of JCB will be final and binding.

14. All right, title and interest, including but not limited to the intellectual property rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with JCB at all times.

15. The Scheme is subject to all applicable central laws of India and state laws and regulations of India.

16. JCB India, its directors, officers, and employees and those of its affiliates, its dealers indemnified and harmless from and against any and all losses, damages, expenses, fees (including legal fees and costs), liabilities whether civil or criminal, arising due to any loss/compensation, whatsoever, occurred to the Customer.

17. The rights and obligations of the Customer and/or JCB/and or Dealer(s) shall be governed and construed in accordance with the laws of India and the courts of competent jurisdiction at New Delhi shall have jurisdiction to determine any and all disputes arising out of, or in connection with, the Scheme.

"Cashback with QR code inside Grease Bucket scheme"

This ‘Cashback with QR code inside Grease Bucket scheme-Terms and Conditions’ (hereinafter referred to as “Terms and Conditions”, contains terms and conditions that constitute a legally binding agreement by and between, JCB India Limited, a company incorporated under the Indian Companies Act, 1956 (hereinafter referred to as the “Company“ or “we”) and each customer (which includes a purchaser /winner) (“You”, “you” or “user”) of the Cashback with QR code inside GreaseBucket scheme (“Program”).

THESE TERMS AND CONDITIONS CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND THE COMPANY.

BY PURCHASING THE GREASE PRODUCTS AS MENTIONED UNDER ANNEXURE-I AND THEREBY PARTICIPATING IN THE PROGRAM, YOU ARE DEEMED TO HAVE READ, ACCEPTED, EXECUTED AND AGREED TO BE BOUND BY THESE TERMS & CONDITIONS AND THE OTHER TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO ANY PROVISION OF THIS TERMS & CONDITIONS, YOU SHALL NOT PARTICIPATE IN THE PROGRAM IN ANY MANNER.

1. CASHBACK WITH QR CODE INSIDE GREASE BUCKET SCHEME

   1. The Company is pleased to announce the Cashback with QR code inside Grease Bucket scheme for customers purchasing the grease products as stipulated in Annexure-I (“Products”) wherein the customers shall be given certain gratification amount as elaborated herein below in this Terms & Conditions. The aforesaid Program shall be applicable and valid on purchase of the Products.

      Notwithstanding anything contained in this Terms and Conditions, the Cashback with QR code inside Grease Bucket scheme shall be subject to availability of the Products with the Company and / or its dealers and distributors.

   2. This Program is exclusively available to customers purchasing the Products until March 31, 2025 (“Program Applicability Period”)

   3. In terms of participating in the Program, the customer shall scan the QR Code printed on a coupon placed inside the respective grease buckets wherein the customer shall be re- directed to a web page requiring him/ her to validate their details inter alia their phone number, PIN Code, UPI ID, PAN etc. Upon, due verification of the details of the Customer, an instant gratification in the form of a pre-decided amount as provided under Annexure- II herein shall be transferred to the account of the customer linked with his / her UPI ID.

   4. It may be duly noted that successful entering in the Program and availing such gratification in connection thereto shall be subject to compliance with all requirements set forth in the gratification web page seeking information / personal information of the Customer. Upon, receipt of the gratification amount in line of the clause above, the customer’s screen shall mention the status of the transactions and the gratification amount along with total gratification received.

   5. It shall be duly noted that the customers shall have the option to contact the helpdesk on 8828027227, as mentioned on the coupon in case of any confusion / query with respect to remittance of the gratification amount. The help desk shall be operational during working hours (10.00 am to 6.00 pm) on weekdays i.e., Monday to Saturday.

   6. Any purchase of Products beyond the scope and Program Applicability Period shall not be governed by this Terms and Conditions and any such purchaser shall not have any rights and / or interests under the Program.

2. ASSUMPTIONS OF RISK

   1. General Assumptions of Risk:

      1. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

      2. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

      3. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

      4. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

3. AMENDMENT TO THIS TERMS AND CONDITIONS

   The Company reserves the right to amend these Terms and Conditions without any prior intimation to the participant / purchasers / customers.

4. PUBLIC ANNOUNCEMENT / ADVERTISMENT

   The Company reserves the right to feature / publicize any number of winners under the scheme on various media touch points as a part of its media campaign.

5. DISCLAIMER

   TO THE EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, WHETHER ARISING FROM OR RELATING TO THIS PROGRAM.

6. COMPLIANCE

   Each Party is solely responsible for making sure that their participation in this scheme is compliant with all laws, rules and regulations applicable to them.

7. MODIFICATION

   The Company reserves the right at any time to change, suspend, or discontinue the scheme in whole or in part with or without notice to the customers. You agree that the Company will not be liable to you for any such act.

8. TAX COMPLIANCE

   In the event the cumulative gratification amounts to more than INR 20,000/- in a financial year, the same shall be subjected to 10% TDS deduction in terms of Section 194R of the Income Tax Act, 1961. Further, the customer agree that it shall be solely liable for determining what, if any, taxes apply to your transactions, as per the applicable laws of any country in which you are residing or are situated. Neither the Company nor any other Third Party is responsible for determining the taxes that may apply to your transactions.

9. DISPUTE RESOLUTION

   In the event of any dispute, all rights and obligations with respect to this Terms and Conditions shall be governed and construed in accordance with the laws of India and the courts at New Delhi, India shall have the jurisdiction to determine any and all such disputes.

10. MISCELLANEOUS

    1. Waiver: The remedies herein reserved shall be cumulative, and in addition to any other remedies provided at law or equity. Any failure by the Company to enforce or insist upon strict compliance with any provision of these Terms shall not be deemed to constitute a waiver of rights to demand strict compliance with the terms hereof. No waiver of any term or condition of these Terms shall be deemed or construed to be a waiver of any subsequent such term or condition in the future.

    2. Severability: Each of the provision of these Terms is separate and severable from the other. Any provision which is invalid or unenforceable, shall be ineffective to the extent of such invalidity or unenforceability, without affecting in any way the remaining provisions hereof.

    3. Entire Agreement: These Terms and the terms and conditions set out in these Platform Terms by reference, constitute the entire agreement between the user and the Company with respect to the subject matter hereof.

The Offer on JCB Rock Breakers ("Scheme") is brought to you by JCB India Limited ("JCB"). Please read these terms and conditions ("T&Cs") carefully before participating in the Scheme. You agree that, by participating in this Scheme, you are deemed to be bound by these T&Cs fully and unconditionally, and you acknowledge and agree that you satisfy all the Scheme eligibility requirements as provided herein below. For the purposes of these T&Cs, wherever the context so requires "You", "Customer" or "Your"; shall mean any natural person who is a participant in the Scheme.

Old Rock Breaker Exchange offer:

1. The customer can avail a special 25% discount on the new purchase in the event of exchange their old rock breaker(s)* for a new JCB rock breaker; and

2. The customer can avail the discount only if the old rock breaker being exchange must be of the same tonne category as the new one being purchased.

   Note : In the event of exchange offer, the customer is not eligible to avail for purchase discount mentioned above in terms mentioned above under the heading of “Rock breaker purchase discounts”. The Dealer and/or JCB shall take the final decision of acceptance of old JCB Rock Breaker under exchange offer under any circumstances.

This ‘Gold Coin Lucky Draw Scheme -Terms and Conditions’ (hereinafter referred to as “Terms and Conditions”), contains terms and conditions that constitute a legally binding agreement by and between, JCB India Limited, a company incorporated under the Indian Companies Act, 1956 (hereinafter referred to as the “Company “or “we”) and each purchaser (which includes a participant /winner) (“You”, “you” or “user”) of the Gold Coin Lucky Draw Scheme.

THESE TERMS AND CONDITIONS CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND THE COMPANY.

BY PARTICIPATING IN THE GOLD COIN LUCKY DRAW SCHEME, YOU ARE DEEMED TO HAVE READ, ACCEPTED, EXECUTED AND AGREED TO BE BOUND BY THESE TERMS & CONDITIONS AND THE OTHER TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO ANY PROVISION OF THESE TERMS & CONDITIONS, YOU SHALL NOT PARTICIPATE IN THE GOLD COIN LUCKY DRAW SCHEME IN ANY MANNER.

1. GOLD COIN LUCKY DRAW SCHEME

   1. The Company is pleased to announce this gold coin lucky draw scheme for grease customers wherein certain lucky participants shall be gifted prize as elaborated herein below. The aforesaid scheme shall only be applicable and valid on purchase of products namely JCB Grease buckets and barrels more clearly mentioned in Schedule I.

      Notwithstanding anything contained in these Terms and Conditions, the Company does not guarantee a purchaser / participant of winning a gold coin and it shall in no manner whatsoever be obligated to perform / undertake any actions in relation thereto.

   2. This gold coin lucky draw scheme is exclusively available to customers purchasing buckets and barrels of JCB Grease and the aforesaid scheme shall be valid from March 01, 2024, to May 30, 2024 (“Scheme Applicability Period”).

   3. The gold coin lucky draw scheme shall be conducted live on Microsoft Teams in presence of dealers, RSMs, RPMs and HQ product support team and shall be conducted after completion of the Scheme Applicability Period.

   4. The winners shall be declared state-wise in such numbers as detailed in Annexure-I herein.

   5. Upon successful completion of the lucky draw as per clause 1.3 above, the dealer’s team shall duly intimate the winners via their registered phone number or e-mail. In the event the contact details provided by the winner is incorrect or that the winner is unreachable on the contact details provided by him/her or if the winner fails to respond within 45 (forty-five) of intimation, the prize of the winner stand shall stand forfeited and the same shall be retained by the Company.

      However, the dealer(s) shall make best efforts to contact the winner and shall have reliable proof certifying the same.

   6. The winner shall thereafter visit the dealers headquarter to collect his / her prize within 30 (thirty) days of intimation.

   7. Any purchase of JCB grease beyond the scope and Scheme Applicability Period shall not be governed by this Terms and Conditions and any such purchaser shall not have any rights and / or interests under the Gold Coin Lucky Draw Scheme.

2. ELIGIBILITY CRITERIA

   1. By participating in the Gold Coin Lucky Draw Scheme, you agree and warrant that:

      1. You are at least 18 years old;

      2. You are capable of entering and authorized to enter into a legally binding agreement; and

      3. You are not impersonating any person or entity.

3. PRIZE

   1. The Company shall gift the winners of luck draw a 22 (twenty-two) karat gold coin weighing 1 (one) gram of Tanishq. It is categorically stipulated that the winners shall not be allowed to barter their prize for cash either to the Company or the dealer.

   2. JCB shall be responsible for payment of TDS charges with respect to gold coin lucky draw, if applicable.

4. ASSUMPTIONS OF RISK

   1. General Assumptions of Risk:

      1. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

      2. The Company declares that the issuance of new regulations, directions, judgements, adaptations by the legal authorities may have an adverse impact on proposed arrangement herein. The Company shall not be responsible for any legal action or loss that you suffer by virtue of a prospective change in law.

      3. Under no circumstances, shall the Company be bound by any liability, obligations and /or responsibility and/or shall be obligated to undertake any actions with respect to the gold coin lucky draw scheme.

      4. The Company shall act within the bounds of the applicable laws. The aforesaid scheme is in consonance with all applicable legislations of India.

      5. The Company shall have the right to hold the scheme in the event of force majeure events.
