- Our LiveLink telematics and connected equipment services;
- Interactions with authorized JCB dealers;
- Marketing, lead generation, and customer support activities; and
- Any other online or offline interactions where this Policy is referenced.
This Policy is designed to comply with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and applicable provincial privacy laws, including Quebec’s Act respecting the protection of personal information in the private sector as modernized by Law 25, as well as the Personal Information Protection Acts of British Columbia and Alberta where applicable.
By using our websites or services, or by providing personal information to us, you acknowledge the practices described in this Policy.

Although JCB Inc. is incorporated in the United States and does not maintain a registered office in Canada, we process personal information of Canadian residents and are committed to meeting applicable Canadian privacy requirements, including those of Quebec Law 25.

We do not knowingly collect personal information directly about equipment operators. Telematics data relates to the machine itself.
Sources of Personal Information
We obtain personal information from the following sources:
- Directly from you (website forms, account registration, support requests, event registrations, marketing preferences);
- From authorized JCB dealers (including when dealers create quotes or opportunities in our systems that include end-customer contact details);
- From LiveLink and other connected equipment systems installed on JCB machines;
- From cookies, pixels, and similar technologies on our websites;
- From service providers and business partners who support our operations; and
- From publicly available sources where permitted by law.
Purposes and Legal Bases for Processing
We collect and use personal information for the following purposes:
- To provide, maintain, and improve our websites, products, and services;
- To process inquiries, quotes, and support requests;
- To administer LiveLink and connected equipment services, including machine monitoring, diagnostics, maintenance alerts, and related support;
- To communicate with you about products, services, promotions, and events (subject to your marketing preferences and applicable consent requirements);
- To personalize content and advertising;
- To analyze usage trends, improve our offerings, and develop new products and features;
- To detect, prevent, and respond to fraud, security incidents, and other harmful activity;
- To comply with legal obligations; and
- For other purposes disclosed at the time of collection or with your consent.
Under PIPEDA and Quebec Law 25, we rely on appropriate legal bases, including consent (which may be express or implied depending on the sensitivity of the information and the context) and, where applicable, legitimate interests that do not override your privacy rights. For sensitive personal information and for certain uses under Quebec Law 25, we obtain express consent where required.
Consent
Where required by law (particularly under Quebec Law 25), we obtain clear, free, informed, and specific consent for the collection, use, and disclosure of personal information. Consent for sensitive personal information is express. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may affect our ability to provide certain services.
For technologies that identify, locate, or profile individuals (including certain cookies and tracking tools), Quebec Law 25 requires that such functions be off by default and activated only with clear affirmative consent.
Disclosure of Personal Information
We disclose personal information to:
- Authorized JCB dealers (to facilitate sales, service, and support);
- Service providers who perform services on our behalf (hosting, analytics, marketing platforms, telematics infrastructure, customer support tools) under contractual restrictions requiring appropriate protection of personal information;
- Professional advisors (legal, accounting, insurance) as needed;
- Affiliates within the JCB group of companies; and
- Authorities or other parties when required by law, legal process, or to protect rights, safety, or property.
When we transfer personal information outside Quebec or outside Canada, we take steps to ensure an adequate level of protection, including contractual safeguards, and, where required by Quebec Law 25, we conduct a privacy impact assessment before the transfer.
LiveLink and Machine Telematics Data
JCB machines may be equipped with LiveLink or similar telematics systems that collect data about the machine, including location, operating hours, diagnostic information, fuel usage, duty cycles, and maintenance-related alerts.
This data relates to the equipment itself and is not used to identify individual operators. We use machine data to provide telematics services and support, improve product performance and safety, facilitate maintenance and warranty activities, and develop our equipment and digital offerings.
If you wish to limit or discontinue collection of certain machine data from a particular piece of equipment, please contact us using the details in Section 14 or through your authorized dealer. We will work with you and, where technically feasible, honor reasonable requests consistent with applicable law and operational requirements.
Cookies and Tracking Technologies
We and our service providers use cookies, pixels, web beacons, and similar technologies. For Quebec residents, non-essential technologies that identify, locate, or profile individuals are off by default and require affirmative consent to activate, consistent with Law 25.
You can manage cookie preferences through our consent mechanism (where available) and through your browser settings.
Your Privacy Rights (Canada)
Under PIPEDA and applicable provincial laws (including Quebec Law 25), you have the following rights:
- Right of Access – Request access to your personal information and information about how it is being used and disclosed.
- Right to Correction / Rectification – Request correction of inaccurate or incomplete personal information.
- Right to Withdraw Consent – Withdraw consent to the collection, use, or disclosure of your personal information, subject to legal or contractual restrictions.
- Right to Data Portability (Quebec) – Request that computerized personal information be communicated to you or to another organization in a structured, commonly used technological format (where required under Law 25).
- Right to De-indexation / Cessation of Dissemination (Quebec) – In certain circumstances, request that we cease disseminating your personal information or de-index hyperlinks.
- Right to Challenge Compliance – Challenge our compliance with applicable privacy legislation.
To exercise any of these rights, please contact us using the methods described in Section 14. We will respond within the timeframes required by applicable law.
Retention
We retain personal information only as long as necessary to fulfill the purposes for which it was collected, to comply with legal obligations, resolve disputes, and enforce agreements. When personal information is no longer required, we destroy or anonymize it securely. Machine telematics data may be retained for longer periods to support product improvement, warranty, and historical analysis.
Security and Confidentiality Incidents
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. In the event of a confidentiality incident that presents a risk of serious injury, we will notify the Commission d’accès à l’information du Québec (where required) and affected individuals, and we maintain a register of confidentiality incidents as required under Quebec Law 25.
Children’s Privacy
Our websites and services are directed to business and commercial users and are not intended for children. We do not knowingly collect personal information from children.
